These Site are controlled, operated and administered by Mercantile from its offices within USA, is intended for residents of USA and its territories.

Choice of Law and Forum; Arbitration

These Terms of Service shall be governed by the laws of the Middlesex County, NJ, USA, without giving effect to its conflict of laws provisions. Any claim or controversy in any way arising out of or relating to these Terms of Service shall be filed in a court of competent jurisdiction sitting in Middlesex County, NJ courts. Both parties consent to exclusive jurisdiction in Middlesex County, NJ, USA, provided, however that either party may elect to settle any litigation in any way arising out of or relating to these Terms of Service by binding arbitration administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures. If elected, such arbitration shall be conducted in Middlesex County, NJ, USA, and judgment on the arbitration award may be entered into any court having jurisdiction thereof.

Except as explicitly stated otherwise, notice to Mercantile shall be given by postal mail to Mercantile International NA, LLC, 1130 Somerset Street, Unit 104, New Brunswick, NJ, USA and notice to You shall be given by an e-mail sent to the address, You provided during the process. In addition, Mercantile may give You notice by certified mail to the postal address provided during the checkout process. Postal notice shall be deemed given 3 days after the date of mailing. E-mail notice shall be deemed given 24 hours after the e-mail is sent, unless the sending party is notified that the e-mail address is invalid.

These Terms of Service constitutes the entire agreement between Mercantile and You with respect to Your use of the Site. Any cause of action You may have with respect to Your use of the Site must be commenced within one (1) year after the claim or cause of action arises. If for any reason a court of competent jurisdiction finds any provision of the Agreement or portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to effect the intent of the Terms of Service, and the remainder of these Terms of Service shall continue in full force and effect.
